following a student riot in college park after a maryland basketball game. prosecutors say the beating was an abuse of power but the officers say they acted lawfully. paul is live with the latest. paul? >> reporter: well, shawn, in many respects this trial really comes down to who you believe and what took place in that video. were the police actually taking part in police brutality and it was john mckenna, the student beaten by the police, was he the aggressor who was threatening to the police. all of that played out in court today. we did he hear from john mckenna and the lawyer who's are representing the police officers who have been charged with assault and misconduct in office. and a lot of what happened that night played out in court today. john mckenna took the stand and told the court he was celebrating maryland's win over duke and had no intention of getting into any trouble when

he was hit by riot police and arrested. he said he was skipping down the sidewalk singing the notre dame fight song when he looked up and saw police on horseback. he told the court he had not heard any announcements to disburse and the officers on knox road said nothing before he was hit to the shield and knocked to the ground. the now 24-year-old doesn't remember being hill but just remembered being thrown into a wagon and received a wound to his head. another student, nathan cole took the stand and say he video taped part of the incident. footage shown to the jury which included audio of someone singing the fight song. mckenna skipped down the sidewalk and never confronted police. joseph rutty told the court that the two officers on trial abused their power and must be held accountable. but defense attorneys both told

the jury the officers didn't know if mckenna was an aggressive agitator, perhaps high on drugs or drunk sand disobeying police act. they called it police authority not brutality. mckenna suffered a concussion that night. he said he was drinking that night but does not remember after being hit by the shield on knox road. the officers say based upon their -- what the lawyers told the jury, that they were operating within their training and that they are certainly not criminals. back to you. >> paul wagner. it will come down to the tape. thank you. >> turning to weather. after a gorgeous weekend, kind of a mixed bag today. the temperatures mild but it has been a gray and damp day with heavy rain in some places. let's join gary mcgrady for a

quick look at the day. hey, gary. >> will, we'll look quickly to radar because we doing have more rain coming through. some of this looked to be maybe some thunderstorm activity but i have not seen any lightning out of this. nothing right now so much over the district. but as we get tighter here, just north of the district, north of the beltway, this is just to the west of i-95, colesville, it is moving off to the east and northeast and so eventually it will get over to beltsville, and cloverly having heavy rain and eventually across i-95. there is a larger line back out to the west and southwest and this is moving in our direction as well. it is moving into northern sections of fauquier county and moving out of page county and ward county. all of this is ahead of a frontal system and i want to

show you the bigger picture with the satellite radar. you can see the showers, again potentially thunderstorms in here as well even though i'm not seeing lightnings. the returns were fairly strong and dynamic so i have to believe that eventually there will be lightning and thunder out of this. it will continue to sweep across with the cold front and as the cold front comes through this evening, this is all going to get better. and as we get tighter here, you can see how everything is moving to the east and northeast. brief heavy rain coming through. it is not a threat for severe. you may get gusty wind, maybe lightning and thunder and that is about it. it will quickly move out of here. improving conditions overnight tonight and it looks like again for tomorrow we'll have a taste of fall in the air. we'll have the full forecast coming up. >> gary, thank you. we'll see you in about 10 minutes. >> i don't know about you, but i can still feel. it all of washington is abuzz over rookie qb robert griffin

than 130-yards in a game since the merger back in 1970. this is the big run. shana hab expects the defenses to honor his arm and most certainly his legs. >> any time you have a quarterback that has a threat of making a play with his legs, a lot of time you have defense spying the quarterback. they want to play man coverage but they don't want to rush everybody because they have to account for the quarterback. just like we saw yesterday. he breaks the scrimmage and he runs. >> i just took off running and the rest is history. i got to enjoy the moment for a little bit. it was fun to hear the crowd and see my teammates on the side lines when i made the touchdown. >> everybody was telling him slide, slide. and everybody goes, keep going, keep going. he's so dynamic.

lay-up. stakes are high for both candidates with steven hess of the brookings institute telling us he expects president obama to put on a stronger showing and should enter the debate with high expectations. >> now the shoe is on the other foot. now he has to worry to living up to expectations and so the next day's story is not just obama did better, we expect that, but that romney fell back. so he's got his own scale that he has to move up. >> well president obama practiced for the first debate out in las vegas but spent his time this weekend prepping in williamsberg, virginia. mitt romney kept his rehearsal sessions in the same place, in the state of massachusetts, and after tomorrow there is one more presidential debate on monday, october 22nd in florida. right now we want to head up to hofstra university on long

island in new york. we bring in joe waldman from wnyw. how are you? >> feeling pretty great. >> give folks a preview of what they are looking at tomorrow night. >> well, i'll tell you what, first of all for the people in d.c., we are 30 miles east of new york city, east of manhattan in a place called hempstead, in long island. and right now the hall is under preparation and it looks like things are good to go. we are expecting about 80-84 uncommitted voters, voters who haven't decided yet who they are voting for or have an idea but can still be swayed one way or another. so those 80 - 84 people, you'll see them on stage tomorrow night with the candidates behind them, since they are doing the last minute preps, they say between 80-84 and not

giving a specific number. hofstra is holding this debate in the second time as as -- in as many election sickles. and the president said it went so well the first time around that the presidential commission on debates decided to come back here for the second presidential election in a row and that's why they are doing it here. >> well, joe, we know these uncommitted voters are going to be giving the questions and we know this pool has been drown around from the area where you are. but folks might off-handedly thinking the state is overwhelming for the president. but there are pockets in long island where republicans are quite strong. what doing we know about the folks on the stage tomorrow night and are they keeping that under lock and key? >> right now, that is pretty much being held under lock and key. what we know, which is no surprise, is new york is really a blue state, not considered a swing state like in ohio or

virginia, florida, one of those states. but nonetheless, people here watched the first debate and the reaction was overwhelmingly the same, which i think it was nationally, which is the president did not come out so strongly. and even the students here seemed to keep a close eye on that debate and new yorkers as a whole are upset with the unemployment figures and some of the other foreign policy issues that we are hearing about right now as well. and i think generally speaking the collective feeling here is that they want to see what both sides have to say and want to see if mr. obama can come out this time around and stir things up, which, again, a lot of the experts say he couldn't doing the first time around. >> joe wal binn from wnyw fox 5 in new york. and again this is a semi- circular town hall meeting. it will be interesting to see whether or not the president can turn around the debate from the first contest. >> it will be interesting to

impacted by a data breach. two encrypted tapes were lost and they contain personal information and social security numbers. now the company is offering free credit monitoring to affected customers. >> in tonight's health alert, a new study shows young girls who receive the hp vaccine don't become sexual after the shot. researchers studied 1400 11 and 12-year-old girls over a three- year period. they didn't ask girls about sex, instead looked at markers of sexual activity, like birth control advice and tests for std and pregnancy. they found that few girls who got the shots had done any of these things by the time they were 14 or 15. >> new cases of fungal meningitis continue to crop up across the country. now there is more than # hundred cases in more than a dozen states, including maryland and virginia. we have the latest tonight.

>> the meningitis outbreak makes its way into new england. according to the center for disease control and prevention and the new hampshire department of health, pain care, a treatment center with multiple locations in the state, received contaminated steroid shots. and at least four patients treated there have been diagnosed with fungal meningitis. >> right now we are concentrating on the patients and getting them evaluated f. there is any cases, we want to catch them right away and make sure they are treated. >> the new england compounding center and the new hampshire company responsible for releasing the tainted shots is now under the microscope. several states launching investigations to see if any cc violated a state license. the necc is authorized to deliver products only in response to patient specific prescriptions and not in nonspecific bulk orders. at least 15 people have died. the cdc said so far 205 cases

up on our accu-weather seven- day forecast. great shot. we are looking out here and you can see the sun going down and the sunburst. and i thought it was a flash of lightning but it is the tower blinking off in the distance there. let me show you what is going on. where we have showers and thunderstorms too. because this down here to the south west of us, thunderstorms. nothing in the district now. but the way this is coming together back out to the west of us, and it is moving in our direction, i have to believe that over the next hour, hour and a half or so, this is going to cruise on across. we zoom down into fauquier county and down to opal, remmington, and up to manassas. this all has a history of lightning and thunder as well and some gusty winds coming out of this as well as heavy rain. this will continue to move on off to the east at about 15-20 miles per hour and again, good rain here moving into manassas now. heaviest of the rain has moved through warrenton and opal and

remmington but heading over to calverton. and eventually this is coming over and then we have a spot firing up around springfield franconia. so i think sue will zoom on down to the district for us here. and so you have that spot south of the beltway there. and then the other one that is cruising through just north of largo now, and that is headed outside of the beltway to the east of us, running along 50 there. so i think bowie will get something, and crofton, and that is showing like some thunderstorm activity as well. we'll just keep an eye on this as it keeps on moving through the area. it is all in advance of the frontal system, that is south of bowie know, and the rain has moved through there. and quickly the cooler temperatures in the wake of this front. dulles 63, frederick is 64. we have cooled down to 66.

scattered showers east of us by 9:00. and then we are partly cloudy around here about 11:00. here is all of the rain, the thunderstorms moving through now. the frontal system is coming on by and in the wake of this front say goodbye to the 70s because it will be very fall- like again for tomorrow. overnight tonight, 52. cooler in the suburbs. we are talking about 40s and it will be breezy. high temperatures tomorrow, lower to mid-60s. we start off chilly and we'll be breezy at noontime. the wind will calm down a little bit toward the latter part of the afternoon. we'll have a good amount of sunshine. as mentioned before, your fox 5 accu-weather seven-day forecast, it is almost hard to believe when you put a seven- day forecast here, out of the seven days you just have one day with some rain and then you have three days with temperatures 70-plus. one day with temperatures in the upper 60s. so it really looks good for the next several days. i hope that holds because it is monday. of course we already care about the weekend.
